Trip Indemnity Clause
1. Release and Waiver of Liability:
All participants, including travelers, volunteers, and organizers (“Participants”), acknowledge that participation in your respective mission trips involves certain inherent risks. By joining this trip, Participants voluntarily assume all risks associated with travel, including but not limited to accidents, injuries, illnesses, property damage, and other unforeseen events.
2. Indemnification:
Participants agree to indemnify and hold harmless Transformation Welfare Society JB and its officers, employees, agents, and representatives (collectively referred to as “the Organizers”) from any and all claims, actions, suits, demands, liabilities, losses, damages, costs, and expenses (including attorney’s fees) arising out of or related to:
* Any injury to Participants or third parties,
* Damage to Participants’ property or third-party property,
* Any breach of this agreement by Participants,
* Any acts or omissions of Participants during the trip,
* Any violation of local laws or regulations by Participants,
* Any claims arising out of the negligence or misconduct of Participants.
3. Insurance:
Participants are strongly encouraged to obtain adequate travel insurance that covers medical expenses, trip cancellations, lost belongings, and other risks associated with travel. The Organizers are not responsible for Participants’ failure to obtain or maintain appropriate insurance coverage.
4. Assumption of Responsibility:
Participants understand that the Organizers are facilitating the trip, but ultimate responsibility for their safety, health, and well-being lies with each Participant. Participants are responsible for complying with all local laws, regulations, and customs during the trip.
5. Emergency Contact and Medical Information:
Participants agree to provide the Organizers with accurate emergency contact and medical information. In case of an emergency, the Organizers will make reasonable efforts to assist Participants but cannot guarantee the availability or quality of medical care in the destination.
6. Governing Law:
This indemnity clause shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from this clause or the trip shall be subject to the exclusive jurisdiction of the courts in Malaysia.
By participating in your mission trip, Participants acknowledge that they have read and understood this indemnity clause and agree to its terms and conditions.
